  • Sending confirmation of or documentation for the registration.

What are the legitimate grounds for processing the User's data?

The legitimate grounds for processing your personal data are the following:

1.      For the purpose of making reservations, both through the Website, the App  and through the contact centre (call centre, email or chat) for individual or group reservations and rooms, including reservations for SPA services, golf courses, classes or personal training, physiotherapy and nutrition services.

  • Execution of the contract between the parties, to manage, process, send, follow up on the reservations made.
  • Explicit consent, in compliance with article 9.2.a) of the GDPR, for the processing of health data related to SPA services or personal training, physiotherapy and nutrition. Not consenting to the processing of this data may imply the impossibility of providing these services, if La Fina Resort cannot guarantee adequate security conditions for the health of you as a customer.

2.    For registration for golf tournaments.

  • Execution of the contract between the parties, to manage, process, send, follow up on the registration.
     

3.    For registration management as a registered user.

  • Execution of the contract between the parties, to manage the User's registration on the Website.

4.    For the management and publication of comments or publications sent by users in the BLOGs owned by URBANIZADORA VILLAMARTÍN.

  • Consent provided by the User. If you withdraw your consent to the treatment of the publication of the comments, they will be deleted by URBANIZADORA VILLAMARTÍN from the Website.

3.    Data provided when registering as a registered user in URBANIZADORA VILLAMARTIN.

  • Companies of the group to which URBANIZADORA VILLAMARTÍN belongs, solely for internal administrative purposes and/or for the purposes indicated above.

4.    Data provided for publications on the BLOGs owned by URBANIZADORA VILLAMARTIN.

  • The data provided by the user will not be communicated to third-party companies. However, it will be published on the Website, meaning it will be seen by all users who access it.

5.    Data provided for the modification and cancellation of reservations.

Likewise, the data may be communicated to the competent authorities and public administrations, in the event of a legal obligation of URBANIZADORA VILLAMARTÍN.

The data may also be accessible to service providers of URBANIZADORA VILLAMARTÍN, being necessary for the proper fulfilment of contractual and legal obligations and/or the purposes indicated above. Said providers will not process your data for their own purposes without prior notification from URBANIZADORA VILLAMARTÍN. 

URBANIZADORA VILLAMARTÍN follows strict criteria for the selection of service providers in order to comply with its data protection obligations, and undertakes to enter into a processing agreement, as required by law, imposing on them, among others, the following obligations: to implement appropriate technical and organisational measures to ensure the security of personal data; to process personal data for the agreed purposes and only in accordance with the documented instructions of the data controller; and to delete and return the data to the data controller upon completion of the services.

Your data will be kept for the following periods:

1.      Data provided for the purpose of making reservations, both through the Website, the App and through the contact centre (call centre, email or chat) for individual or group reservations and rooms, including reservations for SPA services, golf courses, classes or personal training, physiotherapy and nutrition services: shall be kept for the duration of the contractual relationship and, once the contractual relationship has ended, for the period of limitation for any legal actions that may arise from it.

2.    Data provided for registration to golf tournaments: will be kept during the contractual relationship and, once it has ended, for the period of limitation for any legal actions that may arise from it.

3.    Data provided to sign up as a registered user in URBANIZADORA VILLAMARTÍN: will be kept while the status of registered user is maintained and, once the deletion of the account is requested, during the limitation period for any legal actions that may arise from it.

4.    Data provided for publications in the BLOGs owned by URBANIZADORA VILLAMARTÍN: data will be kept as long as the user does not revoke the consent granted.

5.    Data provided for the modification and cancellation of reservations: will be kept during the contractual relationship and, once it has ended, during the limitation period for the legal actions that may arise from it.

6.    Data provided for the sending of our Newsletter: will be kept as long as the user does not revoke the consent given for this purpose.

7.    Data provided in the contact forms and website, including the Chatbot service and WhatsApp attention: will be kept for the period necessary to process and respond to your request and, once complete, during the limitation period for any legal actions that arise from the aforementioned request.

8.    Data provided for the sending of commercial communications, both own and from third parties of the Group: will be kept as long as the user does not revoke the consent given for this purpose.

9.    Data processed for profiling from own sources: will be kept until the user opposes the processing and, in any case, for one year. 

10.  Data processed to carry out Website analysis: will be kept  one year, anonymously.

11.   Data processed for making reservations at the Frijolino restaurant: will be kept during the contractual relationship and, once it has ended, during the limitation period for any legal actions that may arise from it.

User obligations 

The user will:

  • Guarantee that they are over eighteen (18) years of age and that the data provided to URBANIZADORA VILLAMARTÍN is true, exact, complete, and up-to-date. To this end, the user is responsible for the truthfulness of all the data reported and will keep the information provided updated in such a way that it reflects their current situation. 
  • In the event that the data provided belongs to a third party, the user guarantees that they have informed said third party of the aspects contained in this document. The user also guarantees that they have obtained authorisation to provide said data to URBANIZADORA VILLAMARTÍN for the purposes indicated.
  • The user shall be liable for the provision of false or inaccurate information sent through the Website and for any direct or indirect damages incurred by URBANIZADORA VILLAMARTÍN and/or the third parties.

Exercise of rights

URBANIZADORA VILLAMARTÍN will send commercial communications by mail about similar services and those of interest to the user.

However, URBANIZADORA VILLAMARTÍN  offers recipients the option to oppose the processing of their data for promotional purposes, both at the time of data collection and in each of the commercial communications addressed to them.
